Consumer Bankruptcy

There are essentially two Consumer Bankruptcy Chapters available for debtors: Chapter 7 and Chapter 13. Chapter 7 allows for the complete discharge of dischargeable debt and Chapter 13 provides for partial payment of debt through a Court approved plan. Chapter 13 is employed when a debtor’s income exceeds a certain level or when the debtor has a particular asset, such as a car or a home that the debtor has equity in and wishes to keep.
